1. Terms and Conditions

This document containing the general terms and conditions of the Site v2.irinelnicoara.ro/aviatie (hereinafter „Terms and Conditions”) sets the conditions in which a person can visit or access the Site v2.irinelnicoara.ro/aviatie or can use in any circumstance the services provided by this Site.
In the following Terms and Conditions: Site” means hereinafter the website v2.irinelnicoara.ro/aviatie; “Site Administrator” means THE MIRCEA AND DAN CANTACUZINO ROMANIAN MEMORIAL FOUNDATION, fiscal code 32373806, with its headquarters in Bucharest, I.L.Caragiale street, no. 11, Building A, Apartment 1, Room 1, sector 2; “Service” means any service provided on Site and / or any of its modules or parts; “User” means any person who visits or accesses the Site or wishes to use in any manner the Site or actually uses the Site.
The User fully and unconditionally accepts these Terms and Conditions and understands to use the Service under the present Terms and Conditions. The Users understand and accept that the use and any access or visit of the Site and any page thereof and / or use of Service and any of its parts is a fully and unconditional acceptance of the Terms and Conditions and any rule herein. Failure to accept the Terms and Conditions by the Users mentioned above, shall result in their obligation to immediately stop accessing the Site.

2. Content rights of the Site

The content and graphical elements of the Site, including but not limited to them, the entire content in text format and any other document sent in any form to and by the User (by direct visualization on the Site, through newsletters or any other materials related directly or indirectly to the Site) belong to the Site Administrator and its partners and represents the content of the Site.
Notwithstanding the above provision, the Site Administrator and its partners do not own those documents having another owner or rightholder or another source as mentioned on the Site, nor any opinions and/or comments of any kind posted on the Site or regarding the content of the Site in general by the Site Users.
In the cases where the content of the Site, regardless of its place on the Site and its type is copied by the Site Administrator from other producers / content producers or, without limitation, document producers of text format, images, graphics, videos, such publication on Site is made as per specific agreements and legal regulations specific to these cases.
The Users understand and accept that all information, data, materials published on the Site have an informative character and that the Site Administrator cannot be held responsible in any way for the validity and accuracy of the Content of the Site or for any juridical effect derived therefrom.
The Users shall observe all copyrights and related rights, as well as all the intellectual property rights that the Site Administrator and its partners have over / in connection with the Site / its content, the Service, any module or component thereof or in connection with the use thereof. The Users understand and accept that in the event of breach of any of the above provisions whatsoever, they may be held liable by authors / owners of Content of the Site.
The content of the Site, regardless of its place on the Site and its type , can be used only for personal purposes, defined according to this document as purely non-commercial purposes, with no direct or indirect intention of gaining any profit or earnings of any kind from it.

Any person who sends information or materials to the Site in any way undertakes not to affect in any way whatsoever the copyrights that any third person may claim in connection to the materials and information transmitted in any way to the Site and the people sending materials and information to the Site understand and accept that breach in any way of this obligation cannot engage in any way the Site Administrator’s liability, but only the liability of such people.
The users who send any information or materials to the Site in any way whatsoever agree to assign for an unlimited period of time and for all territories, when sending the materials to the Administrator, all the rights of use, modification, alteration or retransmission of the content sent or posted on the Site. The Site Administrator cannot be held liable for any damage caused by the content uploaded or posted on the Site or on any of its modules on the Site by any person, regardless of the section, service, or facility such content is part of .
Any person sending any kind of information, comments, opinions, materials to the Site shall not harm in any way the other Users of the Site by the information, comments and materials sent, and accepts and understands that they are the only liable for the authenticity,accuracy and validity of the information, comments, opinions and materials sent, including but not limited to the legal consequences in connection with their use.
It is strictly forbidden posting any obscene and vulgar content, including without limitation, any materials, comments, images, videos or any other materials containing illegal texts, threats, abusive or indecent materials, racist or chauvinist messages or other materials that may discriminate any person in any way or may violate any human rights and freedoms according to the law.
The Users understand and accept that in case of breach, in any way whatsoever, of any of the Terms and Conditions, the Site Administrator in its sole discretion may choose not to publish any content provided by the User for being posted on the Site or to change in any way any such content,without any prior warnings or notice and without requiring any other formalities in this regard.
The Users understand and accept that the Site offers only an informational and communication platform and that the Users are the only ones responsible for any materials, data and information co posted on the Site on any page or section ( eg., but not limited to, Blog, avatar, comments, etc.) and for any legal and / or commercial effects therefrom.

3. Information note on personal data protection

According to Law no . 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data , amended and supplemented, and the Law. 506/2004 on the processing of personal data and protection of privacy in the electronic communications sector , the Site Administrator will manage safely and only for specified purposes , the personal data of users .
We inform you that the personal data that users provide to the Site Administrator are processed in order to provide optimum Service.
By registering on the Site , loading documents, filling forms or any other way of receiving such personal data , the User agrees that all personal data be included in the database of the Site Administrator and expressly and unequivocally consents to all personal data being stored and used for:

  • marketing activities by receiving information or commercial messages (offers, promotions, advertising and marketing messages) to their e-mail addresses;
  •  participation in competitions, promotions
  • sending non -commercial or administrative notifications ( regarding changes to the site , administration, etc.)
  • internal statistics necessary for improving service quality and image of the Site and for creating new features, promotions, functionalities and services;
  •  to ensure access to restricted sections of the Site;
  •  market surveys;
  •  tracking sales data.

Moreover, the user has the right to oppose the processing of personal data concerning him and request deletion of such data.

The Site Administrator is a personal data controller, registered in the register of the personal data processing.

4. Link to other sites

Users understand and agree that the Site may contain links or references to other sites, including but not limited to personal Sites (blogs), the Sites of products and / or services suppliers/providers that have advertising banners posted on the Site or advertising micro sites, , that are considered by the Site Administrator useful for the Site’s content, but who are not under its control or guidance.
The Site Administrator is held harmless of any liability regarding the content or opinions expressed on the above-mentioned sites, as well as fairness and accuracy thereof, and the Users understand and accept that such internet sites are not monitored , controlled or verified in any way by the Site Administrator .
The inclusion of links or references to other Internet sites does not, in any way, imply approval thereof by the Site Administrator.
When the Users access such internet sites, they do so at their own risk, knowing that the use of the services offered by such sites is subject to the conditions set by the administrators of such sites.

5. Limitation of Liability

The Site Administrator does not undertake or guarantee, implied or express, for the content of any kind of the Site or for the entire content provided by the Users. The Site Administrator will make all reasonable efforts to ensure the accuracy and reliability in the Site and will try to correct the errors and omissions as promptly as possible.
The Site Administrator does not provide any guarantee or liability for the content of the Site and he cannot be held liable for any loss or damage of any nature, that might occur may result from the use of any part, sequence, module of the Content of the Site or inability to use such content, irrespective of the cause, or the misinterpretation of any provision of the Site Content.

The users understand and accept that the Site Administrator is held harmless of any liability in the event of any stoppage, interruption, heaviness, any malfunction, or error in the operation of the Site as well as in any situation where he cannot prove for certain that any such technical errors or problems are due directly and exclusively to fault of the Site Administrator.
Especially, the Users understand and agree that the Site Administrator is held harmless of any liability for any direct or indirect damage, including but not limited to any kind of profit loss or any commercial venue, or other intangible losses, resulted from the usage of the Site Content in any way or any legal consequences deriving therefrom.
The Users understand and accept that the Site Administrator is held harmless for any advertising messages posted on the Site or through the Service and for the goods or services provided by the authors of these advertising messages.
In cases of force majeure, the Site Administrator and/or the operators, the managers, employees, subsidiaries, additional offices,representatives will be held harmless of any liability.
Cases of force majeure include, but are not limited to malfunction of the Administrator’s technical equipment, bad internet connection, bad function of telephone connection, bugs, hacking and tampering with any malicious software, unauthorized access to the Site’s systems, operation errors, strike etc.
The Users agree to protect, ensure and fully compensate the Site Administrator and/or its operators, managers, its employees, subsidiaries, additional offices and representatives for and against any enquiry, claim, action, loss, damage, costs (including without any limitation, attorneys’ fees, experts and consultants or executors fees, legal fees, notary or enforcement), costs, litigation, decisions, fines, adjustments or other obligations arising from or related to any other action of the User in relation to misuse of the Service / Site or any other matter in connection with the Service / Site.

6. Governing law. Litigation

All the rights and obligations of the Users and this Site’s Administrator, stipulated in the Terms and Conditions, as well as the legal effects therefrom, will be construed and governed by the Romanian law. All the litigations arising from or in connection to the Terms and Conditions will be settled amicably. In case the litigations will not be solved amicably, it will be submitted to the competent Romanian court located in Bucharest.

7. Amendment of the Terms & Conditions

The Site Administrator has the right to amend at any time and in any way any provision of the Terms and Conditions or Terms and Conditions in whole, without any previous notice and without being held to fulfil any other formality towards the Users. Any amendment will be treated as fully accepted by the Users by simply using or accesing any facilities provided by the Site or by the Service,or by browsing the Site, at any time after such amendmentand failure to agree to such amendment shall bound the User to immediately end browsing the Site and/or use the Service in any way whatsoever.
